ROUNX LIMITED ("Rounx," "we," "us," or "our") is committed to protecting the intellectual property rights of all users on the Rounx platform at rounx.com (the "Platform"). This page explains how we safeguard creative work, handle claims of infringement, and maintain a trusted environment for clients and talent. This policy should be read in conjunction with our Terms of Service.

1. Our Commitment

Rounx is committed to protecting intellectual property rights. We will respond promptly to credible notices of alleged infringement and, where appropriate, will remove or disable access to material that is found to be infringing or is the subject of infringing activity. In appropriate circumstances, we will also terminate the accounts of users who are repeat infringers.

2. Reporting Intellectual Property Infringement

If you believe that content available on the Platform infringes your intellectual property rights (including copyright, trademark, or other proprietary rights), please submit a written notice to us containing the following information:

  • Identification of the right: a description of the intellectual property right you claim has been infringed, including the type of right (copyright, trademark, patent, etc.) and, if applicable, the registration number.
  • Identification of the infringing material: a description of the material you believe is infringing, with sufficient detail for us to locate it on the Platform (for example, a direct URL or screenshot).
  • Your contact information: your full legal name, mailing address, telephone number, and email address.
  • Statement of good faith: a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the intellectual property owner, its agent, or the law.
  • Statement of accuracy: a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner of the intellectual property right at issue or are authorized to act on behalf of the owner.
  • Signature: your physical or electronic signature (or that of a person authorized to act on your behalf).

We may not be able to act on incomplete or unclear notices. To help us process your request efficiently, please ensure all required information is included.

3. How We Process Infringement Claims

Upon receiving a valid infringement notice, Rounx will:

  • Review the notice for completeness and validity.
  • If the notice is valid, promptly remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material that it has been removed or disabled, and provide them with a copy of the notice (with your personal contact information redacted where appropriate).
  • Retain records of the notice and our response for compliance and legal purposes.

We aim to acknowledge receipt of infringement notices within five (5) business days. The time required to complete the review and take action may vary depending on the complexity of the claim.

4. Counter-Notice Process

If you believe that material you posted on the Platform was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to us containing the following information:

  • Identification of the material: a description of the material that was removed or disabled, and the location where it appeared on the Platform before removal.
  • Statement of good faith: a statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your contact information: your full legal name, mailing address, telephone number, and email address.
  • Consent to jurisdiction: a statement that you consent to the jurisdiction of the courts of the Hong Kong Special Administrative Region for the resolution of any dispute arising from this counter-notice.
  • Signature: your physical or electronic signature.

Upon receiving a valid counter-notice, Rounx will forward the counter-notice to the original complainant. If the original complainant does not take legal action within a reasonable period, we may, at our discretion, restore the removed material.

5. Repeat Infringer Policy

Rounx maintains a policy for the termination of accounts of users who are found to be repeat infringers of intellectual property rights. If a user receives multiple valid infringement notices, we may, at our sole discretion:

  • Issue warnings to the user.
  • Temporarily suspend the user's account.
  • Permanently terminate the user's account and access to the Platform.

We consider the severity, nature, and circumstances of each case in determining the appropriate action. Rounx reserves the right to terminate any account at any time if we reasonably believe the user has engaged in systematic or egregious intellectual property infringement.

6. Trademark Complaints

If you believe that content on the Platform infringes your trademark rights, please follow the same reporting process described in Section 2 above. In your notice, please include the trademark registration details (including jurisdiction and registration number, if applicable) and a clear description of how the material infringes your trademark rights.

7. Misrepresentation

Please be aware that submitting a false or misleading infringement notice or counter-notice may result in liability. If you are unsure whether material on the Platform infringes your intellectual property rights, you may wish to seek legal advice before submitting a notice.

8. Limitations

Rounx acts as an intermediary platform and does not pre-screen all user-generated content for potential intellectual property infringement. Our role is limited to responding to valid notices and taking appropriate action in accordance with this policy. We are not responsible for determining the merits of any intellectual property dispute between users.
